Is Zot legally entitled to get compensation from Wizard Webb Pty. Ltd? or Clause 8 prevents this issue?
Is slowing of images on a Web page a programming issue or not?
Rules
When the parties record their agreement or contract in a document and signed by both of parties, formerly they will obligate by the written terms even they were not aware of the contract conditions (LESTRANGE V GRAUCOB). Therefore, a person by signing the document it means he agreed to all conditions on that contract and it is enforceable term of the contract.
Application
Zot may be covered to achieve compensation from Wizard Webb if slowing of the images is not a programming issue. On the other hand, if programming does not cover the slow of images on the website and clause 8 prevents this then Zot will be not allowed for any compensation.
There are two ways to discuss the issue:
1- Could the slow of images will be a programming issue.
a- If Wizard services made a mistake when the were creating the web site like Incorrect File Paths, they did not use the correct file type, or they did not post the right code to the web site.
