Drug courts are operated to handle adult, non-violent, drug offenders with a substance abuse problem. It is determine on a case by case basis. A judge has to determine if an individual would be better off getting help at a treatment facility or by just going prison. These individuals are given a chance to complete a drug treatment process rather than facing jail time. If they complete the course they will not go to jail. If they fail to complete, they will have to go back in the court system for further evaluation of a sentence (Levinthal, 2012).
