The current New York State mental health counselor Laws, Rules, and Regulations detail a multitude of areas associated with the counseling profession. Professional study and licensing exam are requirements in order to be compliant with these regulations. The study must take place in an accredited organization, and each candidate must successfully pass an examination and pass all requirements required for licensure. There is also an experience component, mental health counselors are required to have completed at least 3,000 clock hours in an acceptable and supervised setting. There are limited permits granted in accordance with specific guidelines. Licensed mental health counselors are granted permission to use various accepted classifications, such as the Diagnostic and Statistical Manual of Mental Disorders. If an applicant is not able to meet requirements for licensure, there are three alternate routes that can be completed in order to become eligible for licensure. Additionally, if an applicant meets all requirements for licensure except for the examination requirement, there is a subdivision that can enable these individuals to qualify. There are two intentions with this bill: the requirement for specific mental health professionals to be required to undergo 36 hours of mandatory continuing education with various exceptions, and the amendment of counseling profession definitions to modify and state such individuals are qualified and able to diagnose at their disclosure within the profession.
