Does California have a Castle or Stand Your Ground Law?
-California is a Castle doctrine law state. However, it contains a stricter form of the law as it does not extend to include protection of other circumstances such as when there is an intruder attempting to commit a crime involving a vehicle or at a place of employment. The California doctrine is only in play when it concerns people in their homes against an intruder, unlike other interpretations of such by other states.
Describe and discuss what you learn
-There are several aspects of these two doctrines and laws that I have come to learn about that I had no prior knowledge of. The first being the fact that several different types of self defense laws pertaining to a person …show more content…
I believe this due to the fact that both include the needed reinforcement for self defense to take place when citizens are found upon dangerous situations. This is so as the Castle doctrine allows for an individual to defend themselves, loved ones, and their property from an intruder as one should without the fear and hesitation of being held legally liable for an act that was meant with the sole intention to diffuse and halt an unsafe and potentially life threatening situation. In which I also believe to be true under the Stand Your Ground law as although it provides citizens with the greater freedom to engage in increasingly more violent and dangerous attempts of self defense, it comes to provide citizens with such freedom if the situation demands for such. In other words, I find such law to be a great implementation into our legal system as it allows for citizens who can and feel the need to truly stand their ground to do so in situations where they not only desire to defend themselves, but also those around them who can possibly be in similar harm due to the public nature present in the event.
Provide an example where you believe self-defense may be appropriate
-A situation where I believe self-defense may be appropriate would be if a family was having a picnic at a park. In which included a wife, her husband, their children and perhaps other family members where such husband excused himself to use the public restroom. And upon such arrival, the husband was held at gunpoint by another male outside the restroom entrance not too far from the picnic area. In which the husband uses force to attempt to disarm the other male and restrain him from not only hurting himself, but his family.
