2. A. Within the Magistrates Court’s Act 1980, under S.19 the courts need to review the evidence, presented by the prosecutor and accused, and come to a decision whether to keep the defendants in custody, or refer them for a trial in the crown court, or to release them due to a lack of evidence.
Magistrates need to decide whether the offence committed is classed as summary only, either way or indictable only offences. Summary only offences (driving) are minor offences which can be dealt by the magistrate. Either way offences (theft, burglary) are more serious offences which tend to be tried in the crown court but could also be tried in the magistrate’s court. Indictable offences (murder, robbery) can only be tried in the crown court.
