Much like any other occupation, personal trainers can suffer severe consequences should they fail to execute their tasks properly. This is why Joann M. Eickhoff-Shemek says, “Given the litigious society, it essential that fitness professionals develop a working knowledge of the law, especially basic concepts related to legal liability and risk management…” (20). If personal trainers leave out any steps when instructing a workout or helping a new member, they will find themselves with a lawsuit on their hands. A court case in Eickhoff-Shemek’s article exemplifies this where personal trainer left a woman on a treadmill, only instructing her how to designate a speed; the woman fractured her ankle and the court ruled against the trainer because of the trainer’s negligence (23). With this in mind, the NCCA accredited certifiers should place more emphasis on issues of personal training involving the law. Yes, while many injuries that are sustained in fitness can be a result of many different situations that are not from the trainer’s arrogance, that is a defective point. Fitness is an ever-increasing trend in the United States; correspondingly, injuries related to working out will rise as well. There has been nearly a fifty percent surge in injuries associated with fitness from the year 1990 to the year 2007, an injury total surpassing 970,000 (Herbert and Ditmyer 39). Adding to that, another article states, “Between 2007 and 2012 there has been nearly a 60% increase in exercise related injuries” (Herbert 13). That is an alarming rate of injuries. It is a bold claim that injuries are not related to personal trainers. wever, injuries are not the only thing that have risen. The number of personal a trainers have increased as well.
